The paper identifies and assesses the implications of two approaches to the field of artificial intelligence and legal reasoning. The first — pragmatism — concentrates on the development of working systems to the exclusion of theoretical problems. The second — purism — focuses on the nature of the law and of intelligence with no regard for the delivery of commercially viable systems. Past work in AI and law is classified in terms of this division. By reference to The Latent Damage (...) System, an operational system, the paper articulates and responds to conceivable purist (jurisprudential and AI) objections to such a program. The methods of the pragmatist are also called into question and refined. The book proposes a critique of scientific determinism that demands an urgent rethinking of causality and proposes a new ethical paradigm.

This article considers Jussi Parikka’s Insect Media: An Archaeology of Animals and Technology and its place within the broader context of neomaterialist philosophy. The question of Insect Media, and indeed of neomaterialism more generally, can be summarized as follows: how might one open oneself to radically alien durations, while remaining politically sensitive to the concomitant risk of technocapitalist capture? Moving through the wide range of subjects engaged with by Parikka, from entomology and cinema to the most advanced forms of programming (...) ecologies, I focus on Parikka’s organizing notion of insects as figuring the molecular disruption of the phantasmatic molar body. For Parikka, it is the swarm that serves as his privileged example, which he locates at the intersection of animal studies, posthumanism and media theory. After outlining Parikka’s important reworking of Bergson’s conception of instinct, understood as ‘intensities’, which functions equally well within the domain of new media, and some of its implications for neo-Darwinism, I then consider Parikka’s ‘melodic’ conception of both nature and technology. Such a conception, I suggest, is problematic in its conflation of nonhuman animals with, for example, software, technologies, viruses and parasites. This in turn puts into question Parikka’s ‘use’ of insects in relation to the claim, common to neomaterialism in general, to have moved beyond an anthropocentric viewpoint. Rather, I argue, such a conception rebuilds a humanist enclosure, albeit one in which, following Guattari, subjectivity can no longer be identified with the individual. Insofar as Parikka designates every nonhuman animal and every machine as beings prior to language and thus prior to intelligence, the non-unitary subject is as a result restricted to the experiencing human subject. This, as Eugene Thacker points out, has serious political implications as regards the attribution of value, or not, to this or that life. However, insofar as Parikka considers instinct as habitual rather than as predetermined and, moreover, extends it to technical beings, I suggest that such a placing of instinct as ‘prelinguistic’ cannot be maintained. By way of conclusion, I appeal for the opening of a dialogue between neomaterialism and deconstruction, with its focus upon language understood in a much broader sense. (shrink)

On the basis of recently discovered documents, the paper discusses the family tree of the Jewish Lasker dynasty, originating from Lask in Poland, formerly Prussia. The common forefather of all Laskers was Rabbi Meier Hindels, who lived around 1700. In Germany, the most successful of his descendants was Dr. Eduard Lasker. He was a lawyer, co-founder of the National Liberal party, and in his lifetime the most conspicuous parliamentary opponent to Reich Chancellor Otto von Bismarck. Germany owes him a considerable (...) part of its present day legal structures in criminal, civil and public law. His younger brother Moritz/Morris settled in Texas and became a prominent figure both in business and society. The Lasker family branch that he established in the United States is still flourishing today and has produced a number of personalities of public renown. While visiting his brother, Eduard Lasker died in New York in January 1884. Edward Lasker, a prominent US-based chess champion, descended from another family branch. One of his nieces, Anita Wallfisch-Lasker, wrote an autobiography that describes her ordeal as a member of the camp orchestra at Auschwitz. (shrink)

Obscurity is not the worst failing, and it is philistinism to pretend that it is. In a series of brilliant essays written over the last fifteen years Stanley Cavell has consistently argued that more important than the question whether obscurity could have been avoided is whether it affects our confidence in the author. Confidence raises the issue of intention, and I would have thought that the primary commitment of a psychoanalytic writer was to pass on, and (if he can) to (...) refine while passing on, a particular way of exploring the mind. Indeed this is how Lacan himself proposes that his work should be judged. “The aim of my teaching,” he writes, “has been and still is the training of analysts.” For decades now Lacan has been insisting that the nature of this commitment has been systematically obscured, particularly in North America. Training has become “routinized”, and analysis itself has become distorted into a process of crude social adaptation. There is much here to agree with. Yet two questions must be raised. Has Lacan devised a more effective method of training analysts? And, would one expect this from his writings? Neither question gets a favourable answer. All reports of his training methods, over which he has now brought about three distinct secessions within the French psychoanalytic movement, are horrifying. 13 It is now, I am told, possible to become a Lacanian analyst after a very few months of Lacanian analysis. And what pedagogic contribution could we expect from a form of prose that has two salient characteristics: it exhibits the application of theory to particular cases as quite arbitrary, and it forces the adherents it gains into pastiche. 14 Lacan's ideas and Lacan's style, yoked in an indissoluble union, represent an invasive tyranny. And it is by a hideous irony that this tyranny should find its recruits among groups that have nothing in common except the sense that they lack a theory worthy of their cause or calling: feminists, cinéastes , professors of literature. Lacan himself offers several justifications for his obscurity, about which he has no false modesty. At times he says that he is the voice, the messenger, the porte-parole , of the unconscious itself. Lacan's claim stirs in my mind the retort Freud made to a similar assult upon his credulity and by someone who had learned from Lacan. “It is not the unconscious mind I look out for in your paintings,” Freud said to Salvador Dali, “it is the conscious.”. In lieu of an abstract, here is a brief excerpt of the content:OSKAR PIEST, 1898-1987 Dr. Oskar Piest, who helped establish the Journal of the Historyof Philosophy, passed away at Sinsheim, Germany, in February 1987. He had studied theology and economics in pre-Hitler Germany, and became a banker in Hamburg. In 1934 he left because of his opposition to the Nazi government and went to Italy, then England, and finally in 1936 to the United States. After World War II he (...) organized and edited the Hafner Library of Classics. In 1949 he and his wife founded the Liberal Arts Press, publishing new, inexpensive, well-edited texts of works in the humanities. This grew into the Library of Liberal Arts which was purchased by Bobbs-Merrill in 1964. Dr. Piest then went to Brussels as a representative for various American banks in connection with the European Economic Community. He retired to Switzerland in 1971, and then to Germany, where he resumed his earlier theological studies, though his health and eyesight were failing. When I visited him in 1984, I found him deeply engrossed in researching pagan religions in the Near East in early Biblical times. He also established a foundation at Mesa College in Grand Junction, Colorado and gave much of his library to them. Dr. Piest worked closely with Herbert W. Schneider, and when the possibility of founding the Journal of the Historyof Philosophyoccurred in 196o and 1961, Dr. Piest was consulted. He met with some of us, gave us his advice, and joined our Board of Directors. He also generously assisted us for several years in financing the publication of the Journal--when such assistance was vital. Thereafter, he continued to be actively interested in the Journal and other projects in the history of philosophy. Although not a professional scholar, he greatly valued work in the history of philosophy to which he made a lasting contribution through his publishing ventures, and through helping to establish theJournal. This book is a critical and analytical survey of the major attempts, in modern philosophy, to deal with the phenomenon of intentionality—those of Descartes, Brentano, Meinong, Husserl, Frege, Russell, Bergmann, Chisholm, and Sellars. By coordinating the semantical approaches to the phenomenon, Dr. Aquila undertakes to provide a basis for dialogue among philosophers of different persuasions. "Intentionality" has become, since Franz Brentano revived its original medieval use, the standard term describing the mind's apparently paradoxical capacity to relate itself to objects existing (...) in the world. One approach to the phenomenon emphasizes the mental act. The author argues that the most adequate account involves elements of both approaches. Contemporary treatments tend to formulate problems of intentionality primarily in terms of logic and semantics rather than those of metaphysics and phenomenology. The possibility of proving the existence of God has fascinated thinkers and believers throughout the centuries. For those like Richard Swinburne, such a project is both worthwhile and successful. For others, like D. Z. Phillips, it is wholly inappropriate. Most critics have simply taken sides at this point; but this book argues a way forward, showing that the disparity between Swinburne and Phillips goes deeper - questioning the fundamental nature of God, the meaning of religious language, and the proper (...) task of philosophy. The author argues that behind each thinker's work, and their attitudes towards proving the existence of God, lies fundamental trust. In his accompanying article, Dr. Kinscherff has convincingly demonstrated why a categorical exclusion of personality disorders from the definition of “mental disease” in insanity defense adjudication is arbitrary, both conceptually and clinically. He explains his position in the context of a vignette involving a hypothetical defendant, Wilhelmina Sykes, charged with ramming her car into another car obstructing her path, causing serious injury to its driver. Dr. Kinscherff correctly points out that the determinative issue in applying the insanity defense in any (...) case, including the hypothetical case involving Ms. Sykes, is whether the defendant experienced a legally relevant functional impairment at the time of the offense. In many states — and in the hypothetical jurisdiction in which Ms. Sykes is being prosecuted — the relevant functional impairments are those that could have affected her ability “to appreciate the wrongfulness of her conduct” or “to conform her conduct to the requirements of the law. POPKIN ONE OF HUME'S MOST FAMOUS CRITICS, the great scientist Joseph Priestley (1733-1804), is scarcely mentioned or studied in the Hume literature.' Perhaps because of the course philosophy followed after Hume, the Scottish Common Sense critics and the German ones connected with Kant are given almost all of the attention. In this paper 1 shall try to correct this (...) oversight, and examine the background of Priestley's critique of Hume, both in terms of Priestley's scientific and religious views and in terms of Hume's influence at the time. I shall then evaluate the merits of Priestley's critique and attempt to determine whether it deserves further study or should be returned to the obscurity it has been in for almost two centuries. 2 Joseph Priestley was a nonconforming minister whose progressively radical views caused him to lose various posts. Eventually he became a millenarian, convinced that crucial signs of the end of the world were at hand: the events of the French Revolution; the purported discovery of the Lost Tribes in Afghanistan by Sir William Jones; plans or hopes for the Jews to return to Palestine and join forces with the Christians. After years of religious wanderings Priestley ended up a millenarian Unitarian, much in the tradition of Sir Isaac Newton, whose religious writing he used extensively, and of Newton's successor, William Whiston? Priestley taught science in various schools and was immensely influenced by David Hartley's Observations on Man. He found in Hartley's theory of association of ideas a naturalistic way of explaining human mental life. And in Hartley's millenarian views he located the sort of theology he was seeking. In a highly original and provocative essay entitled “Behavior, Purpose and Teleology”, published a few years ago, Professors Arturo Rosenblueth, Norbert Wiener and Julian Bigelow attempt to indicate the scientific importance and usefulness of the concepts of purpose and teleology. Since this essay appeared the suggestions it contains seem to have acquired a significance which was not wholly apparent at that time. This is due primarily to the fact that a somewhat novel and, it appears to some, revolutionary approach to (...) certain problems has arisen in the sciences, an approach which is more or less loosely referred to as “cybernetics,” and among whose outstanding spokesmen are to be found the very authors of this essay—particularly Professor Wiener, whose recently published Cybernetics has been claiming the attention of an increasing number of scientists and non-scientists alike. In his book, it may be noted, Professor Wiener, in tracing the development of cybernetics over the past few years, gives a good indication of the importance he attaches to the earlier essay. He writes, with reference to it: “The three of us [Rosenblueth, Wiener and Bigelow] felt that this new point of view merited a paper, which we wrote up and published. Dr. Rosenblueth and I foresaw that the paper could only be a statement of program for a large body of experimental work, and we decided that if we could ever bring our plan for an interscientific institute to fruition, this topic would furnish an almost ideal center for our activity”. It would seem, then, that an examination of the contents of this essay should not be without interest at this time. (shrink)

Memory is everywhere in Blade Runner 2049. From the dead tree that serves as a memorial and a site of remembrance (“Who keeps a dead tree?”), to the ‘flashbulb’ memories individuals hold about the moment of the ‘blackout’, when all the electronic stores of data were irretrievably erased (“everyone remembers where they were at the blackout”). Indeed, the data wiped out in the blackout itself involves a loss of memory (“all our memory bearings from the time, they were all damaged (...) in the blackout”). Memory, and lack of it, permeates place, where from the post-blackout Las Vegas Deckard remembers it as somewhere you could “forget your troubles.” Memory is a commodity, called upon and consumed by the Wallace Corporation, purchased from the memory-maker, Dr Ana Stelline, who constructs and implants “the best memories” in replicants so as to instil in them real human responses. Memory is ubiquitous in Blade Runner 2049, involving humans, replicants, objects, and machines. Even “God,” we are told, “remembered Rachael.” Nowhere, though, is the depiction of memory more important than in the attempt to solve a question of identity. Officer K has a memory of his past. Even though he knows it is an implant, it is a memory he is emotionally attached to, frequently narrating it to Joi, his digital girlfriend. But it is a memory that starts to puzzle and trouble him. When K discovers the remains of a dead replicant, a female NEXUS-7, he uncovers a secret—this replicant was pregnant and died during childbirth, a discovery that could “break the world.” K is charged with hunting down the child and making the problem disappear. Yet as K starts seeking answers to the question of the child’s identity he gets inextricably caught up in the mystery. Is he merely Officer K, or is he Joe, the miracle child of Rachael and Deckard? The answer to this question hinges on K’s memory. But is the memory genuine? Is the memory his? Blade Runner 2049 encourages us to think deeply about the nature of memory, identity, and the relation between them. Indeed, the film does not just serve as a starting point for thinking about philosophical issues related to memory and identity. Rather, as we show in this chapter, the film seems to offer a view on these philosophical issues. Blade Runner 2049 offers us a view of memory as spread out over people, objects, and the environment, and it shows us that memory’s role in questions of identity goes beyond merely accurately recalling one’s past. Identity depends not on memory per se, but partly on what we use memory for. (shrink)

This book shows how political argument in terms of rights and natural rights began in medieval Europe, and how the theory of natural rights was developed in the seventeenth century after a period of neglect in the Renaissance. Dr Tuck provides a new understanding of the importance of Jean Gerson in the formation of the theories, and of Hugo Grotius in their development; he also restores the Englishman John Selden's ideas to the prominence they once enjoyed, and shows how Thomas (...) Hobbes's political theory can best be understood against this background. In general, the book enables us to understand more fully the characteristics of the natural rights theories available to the men of the Enlightenment, and thereby to appreciate the complexity and equivocal nature of modern right theories. He does not consider the suggestions that the occurrence of complex things entails only the occurrence of less complex things, and that analysis might theoretically go on for ever. His argument here seems to me no better than arguing that, if we keep on taking points nearer and nearer to each other, we shall eventually come to two points that are next each other. There must be unanalysed concepts, but there need not be unanalysable concepts. Just so, there must be (...) integers that have never been thought of, but there is no integer that cannot be thought of. Possibly this is concealed from Dr. Ewing by his assuming that, if we analyse x into yz, y and z must have been familiar to us before. This text is an innovative exploration of philosophy and madness in the context of the critical engagement of Heidegger’s phenomenological ontology with Freudian psychoanalysis. Included is a play in which, after a mental breakdown, Martin Heidegger undergoes psychoanalytic treatment from Dr. Medard Boss. Boss is essentially caught between two intellectual giants: his patient, Heidegger, who challenges him to evolve beyond traditional Freudian psychoanalysis, and his mentor, Freud, who acts as a “ghostly” consultant in facilitating Heidegger’s return to health. The dialogue (...) of the play consists of actual quotes taken from the major thinkers themselves, which enhances the authenticity of this fictitious production. In addition, the theoretical perspectives of Freud, Heidegger, Boss, and Ludwig Binswanger are included to enhance the readers’ background knowledge. The Reverend Father, Bernard Lamy, of (...) the Oratory, one of the minor figures of the late seventeenth century who played an important role in the diffusion of Cartesianism and Malebranchism, is hardly known or studied today (and if he is, he is usually confused with, or identified with, his namesake, Dom Franqois Lami, the Benedictine). Dr. Girbal's short biography, based on a great deal of new archival research, gives us a picture of Lamy's career and influence. This work, though very episodic and discontinuous, except chronologically, presents the essential facts of Lamy's activities as a teacher and writer; he set forth major Cartesian, Jansenist, and Malebranchian themes, and was the center of several controversies. His writings, especially his L'Art de Parler, his Entretiens sur les Sciences, and his works on mathematics, were widely read and used until the late eighteenth century. (The list of editions given by Dr. Girbal in his excellent bibliography is most impressive.) Though hardly an original or seminal thinker, Lamy was responsible for popularizing many new themes in pedagogy, science, mathematics, and philosophy, and it is his version of the Cartesian and Malebranchian innovations that was the one known to many of the savants during the century 1675-1775. Since Dr. Girbal's book is basically a bio-bibliography, he, unfortunately, devotes little time or space to analyzing or evaluating Lamy's own ideas. Much of Lamy's career from the 1680's onward was devoted to his theological works and the controversies they started. He seems to have been a mixture of Cartesian in theological method and a crank in interpretation. The long battles about whether Jesus celebrated the Jewish Passover just before his death (which Lamy denied) and the identification of the various Magdelenes in the Biblical literature are described in detail in this study, but little attempt is made to evaluate Lamy as a scholar or exegete for his time. lie hardly appears the equal of his once brother Oratorian, Richard Simon, or his contemporary, Pierre-Daniel Huet, in either his knowledge of the sources or his sense of critical scholarship. In view of the highly sophisticated and learned arguments Simon was carrying on at the time, it is hard to take Lamy seriously in his own context. The appended documents, the texts inddits, included in the volume, are much more interesting. They deal with the crisis at the University of Angers in 1673-76, when Lamy and other Oratorians were forbidden to teach Cartesianism and certain moral and political theories (quite similar in some cases to themes to appear in Malebranche's Traite de Morale.) The documents indicate both the philosophical Cartesian themes that were taught, their applications to theology, especially to the problem of transubstantiation, and the way the struggle went on. It is hardly a case of the war of science versus theology, since both sides, the traditional Aristotelians, and the avant-garde Jansenist and Cartesian oriented Oratorians, were Christian theologians. The Oraterians appear as the apostles of the "new philosophy" as the rationale of Augustinian Christianity, in much the way Malebranche presented the view in his Recherche and later works. The Aristotelians were trying to make the philosophical and scientific past the vested interest of both the Church and State. And, although Lamy was dismissed, and a good, reliable old time Aristotelian was brought back, and although various edicts of both Church and State were used to drive the nefarious new influences out of the University of Angers, the documents also indicate both how the Oratorians continued to carry on their good works for both the "new science and philosophy" and the "true religion" and the kind of support they had in high places in the State.
